1. Applicability
1.1 These terms and conditions apply to all legal relationships between Villa Westergas B.V. (hereinafter: “Villa”) and the visitor or purchaser of tickets and subscriptions for the events, exhibitions, and other activities organized by Villa.
1.2 Deviations from these terms and conditions are only valid if expressly agreed upon in writing.
2. Tickets
2.1 Purchase and use
2.1.1 By purchasing a ticket, the visitor acquires the right to participate in the event or gain access to Villa on the selected date and time.
2.1.2 Tickets are strictly personal and non-transferable without written consent from Villa, unless stated otherwise.
2.2 Cancellations and refunds
2.2.1 Tickets are not refundable or cancellable.
2.2.2 Refunds for already purchased tickets will not occur, even in the case of non-use or no-show.
2.2.3 Villa advises the visitor to carefully choose the correct date and time when purchasing.
2.3 Changes to tickets
2.3.1 A one-time change of the date and/or time of the ticket is possible if this change is requested no later than four (4) hours before the start of the original time slot.
2.3.2 Changes must be made via https://tickets.museumvilla.com/en/change-tickets.
2.3.3 Changes are subject to availability and will only be confirmed after written approval by Villa.
2.3.4 After a change, further changes or cancellations are not possible.
3. Subscriptions
3.1 General provisions
3.1.1 Subscriptions grant access for the agreed period and under the conditions stated at purchase.
3.1.2 Subscriptions are not refundable and not cancellable.
3.2 Exclusion of the right of withdrawal
3.2.1 In accordance with Article 6:230m of the Civil Code, the right of withdrawal is excluded upon the purchase of a subscription, as the subscription is activated immediately and involves a service that starts immediately.
3.2.2 By accepting these terms and placing the order, the consumer expressly waives the right of withdrawal.
4. Changes by Villa
4.1 Villa reserves the right to change opening hours, programs, prices, or other circumstances without prior notice.
4.2 In the event of force majeure or unforeseen circumstances, Villa may cancel events without liability for any damage or refunds.
5. Access and house rules
5.1 Villa reserves the right to deny access to visitors or exclude them if they do not comply with the house rules, behavioral rules, or safety regulations.
5.2 Taking professional photos and videos is only permitted with written consent from Villa.
5.3 It is prohibited to offer goods, services, or information within Villa without permission.
6. Liability
6.1 Villa is only liable for damages caused by intent or gross negligence of Villa or its employees.
6.2 Villa is not liable for indirect damages, consequential damages, lost profits, or damages due to theft or loss of personal property.
7. Privacy
7.1 Villa processes personal data of visitors in accordance with applicable privacy legislation and the Privacy Policy, which can be found at https://www.museumvilla.com/en/privacyverklaring.
8. Complaints
8.1 Complaints regarding the execution of the agreement must be submitted in writing within a reasonable period, but no later than 14 days after the visit, via info@museumvilla.com.
8.2 Villa will address the complaint as soon as possible and seek to reach an appropriate solution.
9. Applicable law and disputes
9.1 Only Dutch law applies to these terms and the agreements they pertain to.
9.2 Disputes will be submitted exclusively to the competent court in Amsterdam, unless mandatory statutory rules prescribe otherwise.
